Cases of carrying three people on a motorbike without being fined will be allowed from January 1, 2025

Starting from January 1, 2025, motorcyclists and moped riders are only allowed to carry two people in four cases (Illustrative photo: Duy Tai).

According to the current regulations in Clause 1, Article 30 of the 2008 Road Traffic Law, motorcyclists and moped riders are only allowed to carry one person, except in the following cases where they are allowed to carry a maximum of two people:

- Transporting emergency medical cases;

- Escorting individuals violating the law;

- Children under 14 years old.

From January 1, 2025, when the 2024 Law on Traffic Safety officially takes effect, there will be an additional case where motorcyclists and moped riders are allowed to carry a maximum of two people without being fined; that is elderly or disabled individuals.

Specifically, Clause 1, Article 33 of the Law stipulates that motorcyclists and moped riders are allowed to carry two people in the following 4 cases:

- Transporting emergency medical cases;

- Escorting individuals violating the law;

- Children under 12 years old (reduced by 2 years compared to the previous regulation);

- Elderly or disabled individuals.

According to the 2010 Law on Disabled Persons, disabled persons are individuals with one or more physical impairments or functional limitations that make it difficult for them to work, engage in daily activities, or learn.

Meanwhile, the concept of "elderly and weak individuals" has not been specifically defined in current legal documents.

If caught carrying more than the allowed number of people, motorcyclists and moped riders will be fined according to Decree 100/2019/ND-CP and Decree 123/2021/ND-CP.

Specifically, carrying two people will result in a fine of 300,000-400,000 VND, while carrying three or more people will result in a fine of 400,000-600,000 VND.

In case of causing a traffic accident, the violator will have their driver's license suspended for 2 to 4 months.
